By engaging with FDC Construction LLC, a registered and bonded Washington State contractor (License No. FDCCOCL825QA), you agree to the following Terms and Conditions which govern the relationship between you (“Client”) and FDC Construction LLC (“FDC,” “we,” or “us”). FDC offers construction and remodeling services, including but not limited to bathroom renovations, and all services are governed by written project agreements or Statements of Work (“SOWs”) that specify scope, fees, materials, and estimated timelines. Clients acknowledge that construction timelines may shift due to material delays, third-party coordination, weather, or unforeseen structural conditions. Clients agree to make payments according to the schedule outlined in the SOW—typically 60% upfront, 20% during project execution, and 20% upon completion—and understand that delays in payment may result in interest charges, project suspension, or legal recovery of amounts owed. FDC warrants all workmanship for two years from completion, covering labor but not materials or manufacturer defects, nor damage caused by misuse, improper maintenance, unauthorized work, natural material changes like wood cupping or concrete cracking, or unapproved site access. Clients are prohibited from entering the work site without coordination and may void warranty by doing so. FDC is not liable for property damage or injuries occurring from unauthorized visits or unsafe site behavior. Clients are responsible for disclosing site conditions including property lines, easements, septic systems, sprinkler lines, or non-public utilities; failure to do so may result in additional charges. FDC is not responsible for asbestos or hazardous material removal; if discovered, work will pause until certified remediation is completed at the Client’s expense. FDC is not liable for undisclosed structural, electrical, or plumbing issues within existing structures and may require change orders and additional payment if such issues are uncovered during demolition or renovation. Any subcontractors engaged are subject to the same standards and oversight as FDC employees. FDC is not responsible for delays caused by suppliers, manufacturers, or parties not under our direct control, and reserves the right to invoice for completed work and secured materials if delays are imposed by third parties or the Client. All construction services are performed as an independent contractor and nothing herein shall be construed to establish a partnership, agency, or employment relationship. Clients must maintain appropriate homeowners or builder’s risk insurance during the term of the project and must furnish proof of coverage if requested. FDC maintains general liability and commercial auto insurance as required by Washington State law. Any property subject to remodeling services may be liened under Washington law if subcontractors, vendors, or suppliers are not paid; for additional protection, Clients may request lien releases directly. All disputes shall be governed by the laws of the State of Washington and will be resolved through arbitration or litigation in the county where services were rendered. In the event of legal action, the prevailing party shall be entitled to reasonable attorney’s fees and court costs. Neither party shall be liable for delays caused by events beyond their reasonable control, including natural disasters, acts of God, labor shortages, or supplier outages. FDC’s liability in any project shall be limited to the total amount paid under the applicable SOW, and we shall not be responsible for indirect, consequential, or incidental damages. Clients may not solicit or hire FDC’s employees or subcontractors directly for a period of one year following project completion without express written consent. These Terms may be updated periodically and apply to all services unless superseded by a fully executed written agreement.
